Terms and Conditions
We are DATI Group Pty Ltd ACN 614 316 844 trading as ‘Approval Ease’ (‘we’, ‘our’ or ‘us’), and we provide a Software as a Service (SaaS) platform designed to streamline the management of TGA approvals for pharmacies, clinics and prescribers, particularly those dispensing medical cannabis, using advanced AI technology.

1. Terms and Conditions (Terms)
These terms govern your access to the Software and our provision to you of a Subscription, including any Free Trial Period, as outlined in these Terms. Please review these terms and conditions carefully before using the Software.
2. Continuous Subscription
Your Subscription will automatically renew unless you notify us of your intent to cancel. It is your responsibility to contact us if you wish to discontinue your Subscription.
3. Agreement to Terms
By creating an Account, paying for your Subscription, or using any portion of the Subscription, you agree to these Terms, forming a binding agreement between you (the user or the entity you represent) and us. We may amend these Terms at any time and will notify you of changes, with continued use of the Software indicating your acceptance of the revised Terms.
4. Term Duration
These Terms begin when you agree to them and continue through the Trial Period, Subscription Period, and any Renewal Periods, unless terminated earlier.
5. Eligibility Requirements
You warrant that you have the legal capacity to enter into this agreement, are authorised to use the payment method provided, and are over 18. The Software is not for unsupervised use by those under 18 or those previously suspended. Usage by minors requires parental consent. If acting on behalf of an organisation (Represented Entity), you confirm you are authorised to bind them.
6. Software and Subscription Details
We will provide the Software and related content (Solution) as per the service level described on our Website. Your Subscription includes specified benefits and limitations, which we may update with notice.
7. Account Registration and Use
To access the Solution, you may need to register an Account, providing accurate and up-to-date personal information. We reserve the right to determine authorised Users and to restrict access as necessary.
8. Data Accuracy and Disclaimer
Our Software utilises advanced technologies to deliver the Solution. While we strive for accuracy, errors may occur due to technology limits or input variations. We do not guarantee accuracy, and reliance on Software Content is at your risk.
9. General Disclaimer
You acknowledge that information provided via the Solution is general and not professional advice. You are responsible for compliance with applicable laws. We act as a conduit for the Solution and are not liable for user input.
10. Software Usage
While your Subscription is active, we grant a non-exclusive, non-transferable licence to use the Software. Sharing with third parties is prohibited. We may release software enhancements, which will not affect these Terms.
11. Support Services
We offer reasonable support for technical issues with the Software. Our response times may vary, and we are not responsible for delays.
12. Data Hosting
We use third-party cloud hosting services, potentially located outside Australia, to store User Data. While we employ measures to ensure secure storage, we are not liable for any unauthorised use, destruction, loss, or alteration of data.
13. Client Obligations
You agree to provide necessary documentation and access to third-party accounts for the Solution. You warrant that materials provided are accurate and authorised.
14. Payment Terms
Subscription Fees are specified on our Website and must be paid in advance. If you are not satisfied, we offer a refund within 7 days of the payment date. Subscriptions automatically renew unless cancelled.
15. Intellectual Property
We retain ownership of Software Content and grant you a licence for its use. You must not reproduce, sell, or modify Software Content without consent.
16. User Data Rights
You grant us a licence to use User Data for providing the Solution and improving services. You are responsible for ensuring User Data compliance with laws and indemnify us against infringement claims.
17. Confidentiality
Each party must protect the other’s Confidential Information and notify of any potential breaches.
18. Limitation of Liability
Our liability is limited to the total Fees paid by you in the five years preceding an event leading to liability. We are not liable for consequential losses.
19. Cancellation Terms
We may terminate this agreement for breach or insolvency. You may cancel your Subscription, which will take effect at the end of the current period.
20. Dispute Resolution
Disputes must be resolved through negotiation before legal proceedings commence.
21. Force Majeure
We are not liable for delays due to events beyond our control, such as natural disasters or government actions.
22. Governing Law
This agreement is governed by the laws of Queensland, Australia. Each party submits to the jurisdiction of Queensland’s courts.
These Terms represent the entire agreement between the parties and supersede all prior agreements. Definitions and interpretation rules apply as outlined in this document.
Acknowledgement of Country
Approval Ease respectfully acknowledges the Turrbal and Yuggera Peoples, the Traditional Owners of the lands on which we live and work in Meanjin (Brisbane). We honor their Ancestors and Elders, past and present, and extend our respect to all First Nations Peoples. We acknowledge their enduring connection to the lands, waters, and communities and recognize First Nations Peoples as the original healers and caretakers of this land. We also pay tribute to all traditional healers practicing today.
